I, {name}, hereby understand and acknowledge that the training, programs and events held by AC Workman LLC/Monsters Bent Barbell may expose me to many inherent risks, including accidents, injury, illness, or even death. I/We assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, and all other such risks being known and appreciated by me. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my.  I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE AC Workman LLC/Monsters Bent Barbell from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the training, programs and/or events. By my signature, I/We indicate that I/We have read and understand this Waiver of Liability.

I, {name},  HAVE READ THE WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.

I, {name}, agree to abide by the below guidelines for membership at Monsters Bent Barbell. 

1. APPLICATION

I apply for membership to Monsters Bent Barbell located at 3011 7^th Street, Parkersburg, WV 26101. I represent and warrant that I am 18 years of age or older and all facts and information set forth above and/or in the Membership Application and Liability Waiver are true, correct and complete.

2. PAYMENT
   1. Daily Payments: Under this option, I must pay, in cash, $10 every calendar day I use Monster Bent Barbell’s gym facilities. I am responsible for using the provided envelopes, filling out the proper information, and placing in the drop box to make my payment.  I must contact Monster Bent Barbell owners, or be a guest of a key holding member to gain access to Monsters Bent Barbell.
   2. Auto Payment: Upon signup with there will be a onetime $20 signup fee added to the first month’s payment. I must pay the Total Due Today upon signing this Contract, based off the current membership prices posted on Monster Bent Barbells website. My next payment will be automatically be removed from my checking account on the 1st of every month.  I can choose to cancel my membership at any time, but will be subject to the signup fee again upon new membership startup.   
   3. Advanced Payment: Upon signup with there will be a onetime $20 signup fee added to my first advanced payment. I must pay the Total Due Today upon signing this Contract, based off the current membership prices posted on Monster Bent Barbells website.  My next payment will be due on the 1st day of the 7^th month of my membership. At that time, I can choose to pay the current Auto Payment rate or the current Advanced Payment Rate for the minimum time required. If not paid in the timeline described below in Section 3 PAYMENT TERMS, I agree to penalties described below in Section 4 CANCELLATION.

3. PAYMENT TERMS

All payments are due on the 1^st of the month.  If payment has not been received by the 10^th of the month, I understand Monsters Bent Barbell will proceed with membership cancellation/deactivation as described in Section 4 CANCELLATION. Monsters Bent Barbell membership are non-refundable for any reason.

If not paid by the 10th of the month, I understand there will be a $5 Late Fee charged to my account.  

4. CANCELLATION
   1. Monsters Bent Barbell has the right to cancel my membership if they have not received payment from me by the 10^th of the month it was due. In cancelling my membership, I understand that they will turn off my key access.  At that time, I understand that I am not permitted to enter via my access key or with other paying members.
   2. Levels of re-instating or re-activating my membership at Monsters Bent Barbell after being cancelled for non-payment. These are based on offenses in a 12 month rolling calendar.
      1. First Offense: $20 fee
      2. Second Offense: $20 fee and must pay 2 months in advance at month to month rate
      3. Third Offense: membership will not be re-instated until 12 months after first offense
   3. If I choose to cancel my Membership, I will contact Monsters Bent Barbell in writing requesting to cancel my membership via email at MonstersBentBarbell@gmail.com or my mail 3011 7^th Street, Parkesburg, WV 26101.  I must cancel my membership no later than 11:59 p.m. on the 20^th of the month before my next payment is due in order for the auto-payment to be stopped.
   4. Monsters Bent Barbell can cancel my membership at any time, without warning if I do not comply with their rules and guidelines described in Section 7 RULES AND REGULATIONS. I understand this occurrence will not warrant any refund of my membership fees.

5. FEE GUARANTEE

Membership fees may be modified from time-to-time by Monsters Bent Barbell.  All membership fees changes will be provided to members, in writing, 30 days in advance to rate change. 

6. MEMBERSHIP PRIVILEGES

I will be admitted 24/7, 365-days per year access to Monsters Bent Barbell. Membership does not cover lessons, classes, individual or group training sessions or special programs, competitions or events.  Memberships are not assignable or transferable.

7. RULES AND REGULATIONS

I acknowledge that Monsters Bent Barbell operates under rules and regulations established for the safety, comfort and protection of members or other patrons.  I will abide by all posted rules and regulations, as well as by rules and regulations subsequently approved and posted or published by Monsters Bent Barbell.  Current Rules and Regulations:

1. Clean up after your workout:
   1. Put away bands/blocks/etc.
   2. Unload/Re-rack weights.
   3. Throw away your trash.
   4. Wipe down machines with provided cleaning supplies.
   5. If you have an issue, please take it to the owners directly. Give us an opportunity to fix it WITHOUT adding drama
2. Bringing a guest to the Gym
   1. If wanting to allow a “trial” membership/free visit, please contact the owners in advance so we are aware. Email MonstersBentBarbell@gmail.com or text 304-916-5370. The guest will still be required to sign liability waiver PRIOR to working out.  This can be found on the daily pay envelope and once signed should be placed in drop box. 
   2. If you bring a guest, your guest must not be left unattended 
   3. You are responsible for making sure they pay the current daily rate in the drop box by placing it in an envelope with their name and signature on guest’s envelope liability waiver. This only applies when not on a trial visit. 
   4. If they do not pay the daily rate or if the advanced request of trial visit is not received, you will be billed their fee.

8. GENERAL PROVISIONS
   1. I acknowledge and agree that the Late Payment Fee represents a reasonable charge for reinstating my membership considering the time and effort required of Monsters Bent Barbell.
   2. I acknowledge that it has been explained to me that this is a legally binding and enforceable contract and that I have agreed to maintain my membership for the period of time specified.
   3. This Contract sets forth the agreement between me and Monsters Bent Barbell regarding my membership and any and all prior discussions, agreements, understandings or correspondence are hereby made null and void.
   4. I understand that I am responsible for all reasonable collection fees, court costs and attorney fees associated with any unpaid balances due according to this Contract.

I/We hereby agree to all terms of this Contract, intending to be legally bound hereby, and each of us has received a complete executed copy of this Contract.
